These Terms and Conditions of Use govern the access to, navigation of and use of the www.curiara.com website and the platform made available through it (hereinafter, \u00abthe Platform\u00bb), and the relationship between Curiara and its users (hereinafter, \u00abUser\u00bb). Please read this information carefully before using the Platform or initiating any operation.<\/p>\n

By accessing, registering and using the Platform, the User agrees to be bound by these Terms and Conditions (hereinafter, \u00abT&C\u00bb). These T&C, together with any other legally relevant terms and information related to the Platform, are available to the User at all times on the Platform and on the www.curiara.com website.<\/p>\n

Important. Curiara is a technology platform only. Curiara is not a payment institution, does not hold or move funds, and does not provide payment services. All payment services in the European Economic Area (EEA) are provided, executed and regulated by Belmoney S.A. (\u00abBelmoney\u00bb). The payment service itself, including the handling of your funds and of your personal data, is governed by Belmoney’s own Terms and Conditions, which you accept separately and which prevail over these T&C in respect of the payment service. 1. PARTIES<\/strong><\/h3>\n

For the purposes of these T&C, the following parties are defined:<\/p>\n

1.1. USER OR CLIENT<\/strong><\/h4>\n

The natural person, aged 18 or over, who \u2014 having met the applicable registration requirements \u2014 accesses, browses, requests and\/or uses the Platform (whether as sender or beneficiary) and who has accepted these T&C as well as the Belmoney Terms and Conditions required to use the payment service.<\/p>\n

1.2. CURIARA<\/strong><\/h4>\n

Curiara Financial Services Inc (hereinafter, \u00abCuriara\u00bb) is the technology provider and owner of the Platform and of the www.curiara.com website. Curiara is an entity established in Miami, USA, with address for these purposes at 8504 NW 66 St., Miami (33166, Florida, U.S.A.) and registration number FT230000411.<\/p>\n

Curiara acts solely as a technology platform that connects the User to the licensed payment institution. Curiara does not provide payment services, does not act as a payment institution, and does not act as agent of Belmoney or of any other party. Curiara provides no payment services on behalf of or for the account of Belmoney.<\/p>\n

1.3. PAYMENT SERVICE PROVIDER<\/strong><\/h4>\n

The payment services necessary to carry out the operations offered through the Platform in the EEA are provided through a white-label partnership with Belmoney S.A., a payment institution licensed and supervised by the National Bank of Belgium, registration number 0540.745.997, with registered office at Avenue Louise 54, 1050 Ixelles, Belgium. Belmoney holds passporting rights to operate in all EEA countries in accordance with PSD2 (Directive (EU) 2015\/2366). All payments in the EEA are powered, executed and processed by Belmoney in accordance with Belgian and European law.<\/p>\n

The provision of payment services by Belmoney is subject to the User’s prior acceptance of the Belmoney Terms and Conditions, available here: https:\/\/bel.money\/terms-and-conditions\/<\/a>. The safeguarding of funds, execution times, refunds, cancellations, liability and the regulatory protections applicable to the payment service are governed by those Belmoney Terms and Conditions.<\/p>\n

2. DESCRIPTION OF THE SERVICE<\/strong><\/h3>\n

The Platform is made available to Users so that they can access the payment services provided by Belmoney in a simple, secure, transparent and fast way, in order to send funds to a beneficiary.<\/p>\n

The payment service consists of receiving funds from a sender \u2014 without any payment account being created in the name of the sender or the beneficiary \u2014 for the sole purpose of transferring an equivalent amount to a beneficiary, or to another payment service provider acting on behalf of the beneficiary, and making those funds available to the beneficiary. This service is provided and executed by Belmoney.<\/p>\n

3. DEFINITIONS<\/strong><\/h3>\n

\u2022 Country of origin:<\/strong> the country from which the User instructs a transfer;<\/p>\n

\u2022 Country of destination:<\/strong> the country where the funds are made available to the beneficiary;<\/p>\n

\u2022 Origin currency:<\/strong> the currency in which the User funds the operation;<\/p>\n

\u2022 Destination currency:<\/strong> the currency in which the funds are made available to the beneficiary, in the local currency of the country of destination;<\/p>\n

\u2022 Exchange rate:<\/strong> the exchange rate displayed to and accepted by the User before confirmation, used to calculate the currency conversion. The exchange rates applicable at any time are shown on the Platform and on the website before the User confirms;<\/p>\n

\u2022 Sender:<\/strong> the natural or legal person who issues a transfer order;<\/p>\n

\u2022 Beneficiary:<\/strong> the natural or legal person who is the intended recipient of the funds;<\/p>\n

\u2022 Order:<\/strong> an action, initiated via the internet or a device used for distance communication, consisting of transferring funds, irrespective of any underlying obligations between the sender and the beneficiary;<\/p>\n

\u2022 Business day:<\/strong> a day on which the payment service providers involved in the execution of a payment transaction are open for business as required for that execution.<\/p>\n

4. OPERATION<\/strong><\/h3>\n

The following explains how the Platform works and the steps to follow to send funds. The payment-related steps below are carried out by Belmoney as the payment service provider; Curiara provides only the technology interface through which the User initiates them.<\/p>\n

4.1. REGISTRATION<\/strong><\/h4>\n

The User must register through the www.curiara.com Platform, providing the information required in the mandatory fields (for example: name, surname, country of residence, country of birth, date of birth, telephone, email, and a personal password).<\/p>\n

The User is responsible for providing truthful and lawful information.<\/p>\n

Once registered, a message is sent to the email address provided, with a link that allows the User to verify that email address, activate the account and accept the applicable terms.<\/p>\n

The User will then be able to access a personal area where additional information may be required (for example, full postal address, occupation and monthly income, and identity-document details: nationality, document type, document number, date of issue, expiry and place of issue).<\/p>\n

A valid identity document must also be provided. Once received together with the information provided, it is reviewed; if correct, the User’s registration is approved and the User is notified that operations may begin. Where there is any doubt about the information provided, additional documentation may be requested, and the User’s profile may be blocked. Identity verification, due diligence and approval form part of the regulated payment service and are carried out by or for Belmoney.<\/p>\n

4.2. PERSONAL AREA<\/strong><\/h4>\n

Once registered, the User has access to a personal area that allows the User to review previous operations organised by date and beneficiary, and to store beneficiary and account details for recurring operations.<\/p>\n

Through the personal area, the User can consult the details and status of operations and exchange communications regarding operations or possible incidents. Strong authentication is required to access the personal area.<\/p>\n

4.3. SENDING FUNDS<\/strong><\/h4>\n

4.3.1. New order.<\/strong> To initiate an order, the User accesses the personal area and selects the \u00abNew transfer\u00bb option, entering the order details (country of destination, beneficiary details including identity document, relationship with the beneficiary, payout method at destination, and amount).<\/p>\n

At that point the User can see the details of the operation: fees, the exchange rate applied, and the final amount the beneficiary will receive in the destination currency.<\/p>\n

If the User agrees with the details, the User must give consent and proceed to the payment phase, in which the User delivers to Belmoney the funds associated with the operation. Before the payment phase, an operation identification code is generated so the User can track the order.<\/p>\n

4.3.2. Payment phase.<\/strong> In this phase the User is asked to deliver the funds associated with the operation, by transfer from an account held by the User or by credit or debit card, as made available by Belmoney. The funding methods, limits, card authorisation and the moment at which an order is deemed received are governed by the Belmoney Terms and Conditions.<\/p>\n

4.3.3. Acceptance and receipt of the order.<\/strong> Orders issued by the User remotely through the Platform are deemed authorised when the User has given consent for execution through the strong-authentication process. The time of receipt of the payment order and the conditions for its execution are determined by Belmoney in accordance with the Belmoney Terms and Conditions and applicable law.<\/p>\n

4.3.4. Irrevocability and refusal of an order.<\/strong> The conditions under which an order may or may not be revoked, refused or returned \u2014 and the handling of any resulting refund \u2014 are governed by the Belmoney Terms and Conditions and by applicable law.<\/p>\n

4.3.5. Execution time.<\/strong> Execution times depend on the corridor, the payout method, bank cut-offs, applicable controls and time zones. Estimated times are displayed before the User confirms; they are indicative and are set and guaranteed (where applicable) by Belmoney in accordance with the Belmoney Terms and Conditions and applicable law.<\/p>\n

4.3.6. Proof of operation.<\/strong> The User will receive, in the personal area and\/or through the established contact channel, a receipt with the details of the operation: operation reference; amount in the currency used; total fees and charges, duly itemised; exchange rate used; date of receipt of the order; and identification of the sender and beneficiary.<\/p>\n

5. CHARGES, APPLICABLE FEES AND EXCHANGE RATES<\/strong><\/h3>\n

Registration and use of the Platform itself imply no cost for the User. However, use of the payment service is subject to specific costs.<\/p>\n

The exchange rate applicable to any currency conversion, and the fees applicable to the operation, are displayed on the website and on the Platform before the User confirms the operation. The User must pay the charges and fees applicable to the relevant operation. The beneficiary will receive the net amount stated in the order, after deduction, where applicable, of any charges and taxes applicable in the country of destination.<\/p>\n

The setting of fees and exchange rates, any spread earned on currency conversion, balance-management charges on undeliverable funds, and charges arising from revocation or from recovery of funds sent with an incorrect beneficiary identifier, form part of the payment service and are governed by the Belmoney Terms and Conditions.<\/p>\n

6. RESPONSIBILITIES OF THE PARTIES<\/strong><\/h3>\n

6.1. Curiara (the Platform).<\/strong> Curiara is responsible only for providing and maintaining the technology Platform and website through which the User accesses the payment service. Curiara does not execute payments, does not hold User funds, and is not the provider of the payment service. Curiara is not responsible for the execution, non-execution or defective execution of any payment operation, which is the responsibility of Belmoney.<\/p>\n

6.2. Belmoney (the payment service provider).<\/strong> Belmoney is responsible, as the licensed and regulated payment institution, for the execution of payment operations, the safeguarding of funds, the handling of unauthorised, non-executed or incorrectly executed operations, refunds, and the regulatory protections applicable to the User. These responsibilities, including time limits for reporting unauthorised or incorrect operations, are set out in the Belmoney Terms and Conditions and in applicable law. Where a payment order is executed in accordance with the unique identifier provided by the User, it is deemed correctly executed in respect of the beneficiary; the consequences of an incorrect identifier supplied by the User are addressed in the Belmoney Terms and Conditions.<\/p>\n

6.3. Events beyond control.<\/strong> Neither Curiara nor Belmoney assumes responsibility for damage arising from unusual and unforeseeable events outside their reasonable control whose consequences could not be avoided despite due diligence (for example, failure of telecommunication lines, civil disturbances, natural disasters, epidemics or pandemics, or war).<\/p>\n

7. TECHNICAL AND SECURITY REQUIREMENTS<\/strong><\/h3>\n

The Platform is available on the internet at www.curiara.com. The security of communications between the Platform and Users is protected by an SSL\/TLS certificate that encrypts the flow of information so that it travels securely over the network. The payment service applies additional security measures, including 3D Secure verification for card operations, as provided by Belmoney.<\/p>\n

It is the User’s responsibility to keep registration data (for example, usernames and passwords) secure and to prevent access by unauthorised third parties.<\/p>\n

8. INTELLECTUAL PROPERTY<\/strong><\/h3>\n

Curiara, by itself or as an assignee, owns all the intellectual and industrial property rights in its Platform and website, as well as the elements contained therein (by way of example: images, sound, audio, video, software and text; trademarks and logos; colour combinations; structure and design; the selection of materials used; and the computer programs necessary for their operation, access and use), which belong to Curiara or to its licensors.<\/p>\n

All rights reserved. The reproduction, distribution and public communication \u2014 including making available \u2014 of all or part of the contents of this website for commercial purposes, in any medium and by any technical means, is expressly prohibited without Curiara’s authorisation. The User may view, and may print, copy and store the elements of the website and Platform, solely and exclusively for personal and private use. The User must not delete, alter, circumvent or manipulate any protection device or security system installed on the website or Platform.<\/p>\n

9. EXCLUSION OF GUARANTEES AND USER RESPONSIBILITY<\/strong><\/h3>\n

Curiara is not responsible, in any case, for damage of any kind that may arise from, by way of example: errors or omissions in the contents; unavailability of the Platform; or the transmission of viruses or malicious programs, despite Curiara having adopted the technological measures reasonably necessary to prevent this.<\/p>\n

The User is solely responsible, before third parties, for any communication sent personally or on the User’s behalf to the website, and for any unlawful use of its contents and services. The User undertakes to make appropriate use of the contents and services and, by way of example but not limitation, not to use them to: (i) engage in unlawful or illegal activities or activities contrary to good faith and public order; (ii) cause damage to the physical or logical systems of Curiara, its providers or third parties, or introduce or spread computer viruses or other systems liable to cause damage; or (iii) attempt to access or use the accounts of other Users.<\/p>\n

10. LINKS<\/strong><\/h3>\n

Curiara does not assume responsibility for the contents of links belonging to third-party websites, nor does it guarantee the technical availability, quality, reliability, accuracy, completeness, truthfulness or validity of any material contained in such hyperlinks or third-party sites. The inclusion of these external connections does not imply any association, merger or participation with the connected entities.<\/p>\n

11. PREVENTION OF MONEY LAUNDERING AND TERRORIST FINANCING<\/strong><\/h3>\n

The prevention of money laundering and terrorist financing in connection with the payment service \u2014 including customer due diligence, the verification of identity, beneficial ownership, activity and source of funds, the reporting of suspicious facts or operations to the competent authorities, and the retention of customer documentation for the periods required by law \u2014 is carried out by Belmoney as the regulated payment institution, in accordance with the Belmoney Terms and Conditions and applicable Belgian and EU legislation. Where the Platform collects information for these purposes, it does so on behalf of and as instructed by Belmoney.<\/p>\n

12. CUSTOMER SERVICE AND COMPLAINTS<\/strong><\/h3>\n

For questions or complaints regarding the Platform (for example, the website or the technology interface), the User may contact Curiara at: atencionalcliente@curiara.com.<\/p>\n

For questions or complaints regarding the payment service (for example, the execution of an operation, fees, exchange rates, refunds or unauthorised operations), the User should contact Belmoney. Belmoney’s complaint-handling procedure, the applicable time limits, and the available alternative dispute-resolution options (including the Belgian financial ombudsman, Ombudsfin, and the European Online Dispute Resolution platform) are set out in the Belmoney Terms and Conditions: https:\/\/bel.money\/terms-and-conditions\/<\/a>.<\/p>\n

13. DATA PROTECTION<\/strong><\/h3>\n

Curiara acts only as a technology bridge between the User and Belmoney. Curiara is not<\/strong> the controller of the personal data processed in connection with the payment service.<\/p>\n

13.1. Payment service data \u2014 Belmoney as controller.<\/strong> All personal data submitted by the User for the purpose of registering for and using the payment service \u2014 including identity and contact details, identity documents, KYC and due-diligence information, beneficiary details and transaction data \u2014 is collected for, and controlled by, Belmoney S.A. as the data controller, in its capacity as the authorised and regulated payment institution. The processing of that data, the legal bases relied upon, any international transfers, the retention periods, and the exercise of data-subject rights (access, rectification, erasure, restriction, portability and objection) are governed by Belmoney’s Privacy and Cookie Policies and by the Belmoney Terms and Conditions, in accordance with the GDPR (Regulation (EU) 2016\/679) and applicable law. Where the Platform collects such data, it does so on behalf of and as instructed by Belmoney.<\/p>\n

13.2. Website data \u2014 Curiara as controller.<\/strong> Curiara acts as controller only in respect of the data its own website collects through cookies and analytics on www.curiara.com (for example, navigation data and similar technologies). This limited processing is governed by Curiara’s Cookie Policy and consent tools available on the website, in accordance with the GDPR and Spanish data-protection legislation (Organic Law 3\/2018, LOPDGDD). The User may manage or withdraw consent at any time through the consent tools on the website.<\/p>\n

13.3. Exercise of rights and complaints.<\/strong> To exercise data-subject rights in relation to the payment service, the User should contact Belmoney as indicated in Belmoney’s Privacy Policy. In relation to website cookies and analytics, the User may contact Curiara. A User may also lodge a complaint with the competent supervisory authority.<\/p>\n

14. LANGUAGE AND COMMUNICATIONS<\/strong><\/h3>\n

These T&C are made available in English alongside other language versions offered on the Platform. If the User so requests, information about an operation and the general conditions may be provided on paper or on another durable medium.<\/p>\n

15. MODIFICATIONS TO THE WEBSITE<\/strong><\/h3>\n

Curiara reserves the right to make the modifications it deems appropriate to its website and\/or Platform, and may change, remove or add contents and services, as well as the way in which they are presented or located on the website. Curiara reserves the right to deny or withdraw access to its Platform or website, without prior notice, to Users who fail to comply with these T&C. The version of the T&C published on the Platform and\/or website at any given time is the version in force.<\/p>\n

16. APPLICABLE LAW AND JURISDICTION<\/strong><\/h3>\n

These T&C, which govern the use of the Curiara Platform, are governed by the laws of the Kingdom of Spain, and any dispute relating to them shall be submitted to the Courts and Tribunals corresponding to the domicile of the User or the place of performance of the obligation, at the User’s option.
