Because we understand that the process is hard, confusing, full of formalities, waiting and decisions that mark the future. And because we believe that, if we share what we have learned, it can serve as a guide for you along the way.<\/p>\n\n\n\n<p>We tell you about it ourselves, who know very well what it means to leave behind<strong> Venezuela<\/strong>. It is not only<strong> <\/strong><a href=\"https:\/\/curiara.com\/en\/tips-for-moving-to-the-united-states\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>move to another country<\/strong><\/a><strong>,<\/strong> It is learning to live with the constant nostalgia of the aroma of grandma's coffee, of bagpipes in December, of long hugs, of the family reunited on a Sunday. What can we do to stay legally? What kind of visa is the right one? How can we bring our family back?<\/p>\n\n\n\n<p>The first major key is to understand <strong>what types of residency in the United States<\/strong>and how one differs from the other. Knowing this will allow us to make better decisions and avoid mistakes that can cost time, money and peace of mind.<\/p>\n\n\n\n<p>Being informed, asking questions and surrounding yourself with good sources is key. Because yes, starting over is a big challenge, but it is also an opportunity. They are <strong>permits<\/strong> that allow us to remain in <strong>United States<\/strong> for a<strong> limited time<\/strong>for specific purposes: <strong>tourism, studies, work, medical treatment<\/strong>among others. They do not allow us to stay indefinitely, but can be the first step towards a more stable situation. Examples of temporary residence:<\/p>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h4 class=\"wp-block-heading\"><strong><span style=\"text-decoration: underline\">Tourist Visa (B-1\/B-2)<\/span><\/strong><\/h4>\n\n\n\n<p>Although it is not considered<strong> residence<\/strong> as such, most people access it by this route. It can be used for tourism, business or medical treatment, but <strong>does not allow to work<\/strong> or become legally established.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Duration:<\/strong> up to 6 months.<\/li>\n\n\n\n<li><strong>Procedure:<\/strong> through the <strong>consulate or <\/strong><a href=\"https:\/\/ve.usembassy.gov\/es\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>embassy<\/strong><\/a>. It must be demonstrated that one has the means to support oneself and the intention to return to the country of origin.<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h4 class=\"wp-block-heading\"><strong><span style=\"text-decoration: underline\">Student Visa (F-1\/M-1)<\/span><\/strong><\/h4>\n\n\n\n<p>If you have been accepted by a <strong>university<\/strong> o <strong>educational institution<\/strong> In the U.S., this visa allows you to study legally and, in some cases, to work on campus or do an internship.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Prerequisite:<\/strong> Letter of acceptance, financial solvency, and in many cases, interviews.<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h4 class=\"wp-block-heading\"><strong><span style=\"text-decoration: underline\">Temporary work visas (H, L, O, etc.)<\/span><\/strong><\/h4>\n\n\n\n<p>There are different options depending on the profile:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>H-1B<\/strong>: professionals with <strong>university degree.<\/strong><\/li>\n\n\n\n<li><strong>L-1<\/strong>transfers within the same company.<\/li>\n\n\n\n<li><strong>O-1<\/strong>Extraordinary talent or abilities (artists, scientists, athletes).<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<p><strong>Important:<\/strong> It cannot be applied for directly, it must be arranged by a sponsoring company.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Permanent Residence (Green Card)<\/h3>\n\n\n\n<p>This is the <strong>goal of many of us<\/strong>. The <a href=\"https:\/\/curiara.com\/en\/green-card-application-for-venezuelans\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>Green Card<\/strong><\/a> allows us to live, work and study in the U.S. without time limits. It also opens the door to citizenship, if certain requirements are met.<\/p>\n\n\n\n<p>To reach this point, one of the key steps is to <strong>the <\/strong><a href=\"https:\/\/curiara.com\/en\/green-card-interview\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>final interview<\/strong><\/a><strong> with immigration<\/strong>The application is reviewed, all documentation is reviewed, the information provided during the process is validated and, in some cases, the veracity of the family or employment relationship that supports the application is evaluated.&nbsp;<\/p>\n\n\n\n<p>Below we explain the most common ways to obtain the <strong>Green Card:<\/strong><\/p>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h4 class=\"wp-block-heading\"><strong><span style=\"text-decoration: underline\">By family relationship<\/span><\/strong><\/h4>\n\n\n\n<p>If we have a close family member who is already a citizen or permanent resident, you can initiate a petition to be reunited with them.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>U.S. Citizen<\/strong>You may apply for your spouse, children, parents or siblings.<\/li>\n\n\n\n<li><strong>Permanent resident<\/strong>You can ask your spouse or unmarried children.<br><\/li>\n\n\n\n<li><strong>Procedure:<\/strong> the family member must file an application with <a href=\"https:\/\/www.uscis.gov\/es\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>USCIS<\/strong> <\/a>(Form I-130). Depending on the type of bond, waiting times vary widely.<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h4 class=\"wp-block-heading\"><strong><span style=\"text-decoration: underline\">By employment<\/span><\/strong><\/h4>\n\n\n\n<p>This route requires that a company in <strong>USA<\/strong>. is willing to sponsor our <strong>permanent residence<\/strong>. It is usually applied to professional profiles with high demand or specific experience.<\/p>\n\n\n\n<p><strong>Process:<\/strong><\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Labor certification (<\/strong><a href=\"https:\/\/curbelolaw.com\/es\/certificacion-laboral-perm-paso-a-paso\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>PERM<\/strong><\/a><strong>): <\/strong>the company must demonstrate to the<strong> Department of Labor <\/strong>that has not found <strong>U.S. workers<\/strong> available or qualified for the position. It is a rigorous process that involves posting job advertisements and justifying the need to hire a foreign person.<br><\/li>\n\n\n\n<li><strong>Immigration Petition (Form I-140): <\/strong>Once the certification is approved, the company submits a formal request to the <strong>Citizenship and Immigration Service<\/strong> (USCIS), confirming that it wishes to hire the applicant and that he\/she meets the requirements of the position.<br><\/li>\n\n\n\n<li><strong>Adjustment of status or consular processing: <\/strong>depending on whether you are already in<strong> USA. USA.<\/strong> or outside the country, the adjustment is made to<strong> <\/strong><a href=\"https:\/\/www.uscis.gov\/es\/i-485\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>status (I-485)<\/strong><\/a> or the process is continued in the <strong>consulate<\/strong> corresponding.<br><\/li>\n<\/ol>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h4 class=\"wp-block-heading\"><strong><span style=\"text-decoration: underline\">Diversity Visa Lottery (Diversity Visa Program)<\/span><\/strong><\/h4>\n\n\n\n<p>Each year, the diversity program <strong>awards 55,000 Green Cards<\/strong> people from countries with low immigration to the United States. <strong>Venezuela <\/strong>has been included in some years.<\/p>\n\n\n\n<p><strong>Compliance is required:<\/strong> Minimum level of education, good track record and the conditions established by the <strong>Department of State.<\/strong><\/p>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h4 class=\"wp-block-heading\"><strong><span style=\"text-decoration: underline\">Political asylum<\/span><\/strong><\/h4>\n\n\n\n<p>Many compatriots have taken this route. It is an option for those who can demonstrate that they have suffered <strong>persecution in Venezuela<\/strong> for political, social, religious or sexual orientation reasons.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Procedure:<\/strong> can be applied for upon entry to the country or within the first year of stay.<\/li>\n\n\n\n<li><strong>Advantages: <\/strong>work permit after a few months and the possibility of applying for residency after one year of approval.<\/li>\n\n\n\n<li><strong>Requires:<\/strong> solid evidence, coherence in the story, and if possible, legal advice.<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p><strong><span style=\"text-decoration: underline\">TPS (Temporary Protected Status)<\/span><\/strong><\/p>\n\n\n\n<p>The <strong>TPS <\/strong>has been a lifesaver for thousands of <strong>Venezuelans<\/strong>. Although it is not a residence as such, it allows you to live and work legally while it is in force.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Procedure:<\/strong> with USCIS, with specific dates for registration or renewal.<\/li>\n\n\n\n<li><strong>Important note:<\/strong> does not lead directly to the<strong> Green Card<\/strong>but it does allow <strong>change status<\/strong> if another opportunity arises (such as marriage, job offer or approved asylum).<\/li>\n\n\n\n<li><strong>Current warning:<\/strong> the situation of the <strong><a href=\"https:\/\/curiara.com\/en\/what-will-happen-tps-for-venezuelans\/\">TPS for Venezuelans in the United States<\/a><\/strong> faces significant uncertainty. On May 19, 2025, the <strong><a href=\"https:\/\/www.bbc.com\/mundo\/articles\/cq54w1jze5po\" target=\"_blank\" rel=\"noreferrer noopener\">U.S. Supreme Court authorized Donald Trump's administration to revoke the TPS. <\/a><\/strong>granted to approximately 350,000 Venezuelans, a measure that had been extended until October 2026 by the previous administration. Although the designation of <strong>2021 TPS <\/strong>for Venezuela remains in effect until<strong> September 10, 2025<\/strong>The current administration has expressed its intention to cancel it as soon as it obtains judicial authorization.  <strong>Immigrant rights organizations and community leaders<\/strong> have urged those affected to seek legal advice and to keep informed about possible <strong>changes in your immigration status<\/strong>.<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What can we do to move forward safely?<\/strong><\/h2>\n\n\n\n<figure class=\"wp-block-image size-full\"><img decoding=\"async\" width=\"800\" height=\"533\" src=\"http:\/\/curiara.com\/wp-content\/uploads\/2025\/05\/seguir-avanzando-residencia-eeuu.jpg\" alt=\"moving forward u.s. residency\" class=\"wp-image-10003\" title=\"moving forward u.s. residency\" srcset=\"https:\/\/curiara.com\/wp-content\/uploads\/2025\/05\/seguir-avanzando-residencia-eeuu.jpg 800w, https:\/\/curiara.com\/wp-content\/uploads\/2025\/05\/seguir-avanzando-residencia-eeuu-300x200.jpg 300w, https:\/\/curiara.com\/wp-content\/uploads\/2025\/05\/seguir-avanzando-residencia-eeuu-768x512.jpg 768w, https:\/\/curiara.com\/wp-content\/uploads\/2025\/05\/seguir-avanzando-residencia-eeuu-18x12.jpg 18w\" sizes=\"(max-width: 800px) 100vw, 800px\" \/><\/figure>\n\n\n\n<p>When faced with the <strong>migration process<\/strong>It is normal to feel overwhelmed. The forms, the deadlines, the requirements and the uncertainty can generate doubts and fear. But there are concrete actions we can take to move forward with more clarity and security on this path.&nbsp;<\/p>\n\n\n\n<p>From our collective experience, here are some steps that really make a difference:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Inform ourselves well<\/strong>always from official and updated sources. Misinformation can cause us to waste time or even make costly mistakes. It is essential to consult directly the <a href=\"https:\/\/www.uscis.gov\/es\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>USCIS<\/strong><\/a>,<strong> embassies or reliable legal sources<\/strong><\/li>\n\n\n\n<li><strong>Consult with professionals, <\/strong>every case is different. What worked for one person may not apply to another. In sensitive processes such as <strong>asylum<\/strong>the residence or the <strong>change of status, <\/strong>have a <strong>specialized lawyer<\/strong> can be the key between moving forward or remaining stagnant.<\/li>\n\n\n\n<li><strong>Organizing our documents<\/strong>Keeping an orderly record of entries, exits, applications, contracts, studies, receipts, and any document that reflects our activity and roots in the country can greatly facilitate any future immigration proceedings.<\/li>\n\n\n\n<li><strong>Keeping calm and perseverance<\/strong>We know that processes can take months or even years, but keeping calm and not giving up is as important as any form.
