LEGAL BASES OF THE PROMOTION
1. PROMOTION ORGANIZER
CURIARA SERVICIOS FINANCIEROS S.L. (hereinafter, “CURIARA”), domiciled at Calle Columela 5, 2-D 28001 Madrid and with Tax ID number B-88568944, organizes the promotion “CURIARA BIRTHDAY SWEEPSTAKES” (the “Promotion”) in order to promote its CURIARA brand on Instagram, and which will be governed by means of the following legal bases (the “Legal Bases”):

Time scope
The period of participation will be from August 17, 2021 to August 31, 2021, inclusive.
CURIARA reserves the right to cancel the Promotion early or extend it in time.
Promotion Communication
The Promotion will be communicated to the public, by CURIARA, through the Instragram and Twitter accounts @enviatucuriara.
Participants
Only individuals over 18 years of age with legal residence in Spain who have accepted these Terms and Conditions, as well as each of its terms and conditions, and comply with them, may participate in the Promotion.
However, partners, administrators, employees, workers, employees or relatives of CURIARA, or of the companies listed below, may not participate in the Promotion:
– Of the distribution companies that are owners, concessionaires, lessees or franchisees of the centers where the promoted product is sold.
– From supplier companies.
– Of the companies in charge of the creation and management of the advertising campaign.
– From the companies in charge of printing and disseminating the campaign components.
In general terms, no person, or relative thereof, who has been a direct or indirect collaborator of the aforementioned companies or who for any reason has been involved in the creation or execution of this Promotion, may participate in the Promotion.
Territorial scope
The territorial scope of the Promotion is the European Community and the UK.
Promotion Brand
The promoted brand that allows participation in this Promotion is CURIARA.
Description of awards
CURIARA will give each of the 5 winners (1) of this Promotion a remittance of 50€ to send to Venezuela.
MECHANICS OF THE PROMOTION
Participation in the Promotion is completely free of charge, except for the cost of access and/or use of the Internet, which will be borne entirely by the participant.

The winner of the Promotion will be determined as follows:
The winners of the Promotion will be determined on September 1, 2021, by drawing lots. There will be one winner among those who participate on Twitter and 4 Instagram. The name of the winners will be drawn from the list of comments of the Promotion, using a computer application enabled for this purpose and which guarantees the randomness of the draw. It is convenient to mention the tool with which the sweepstakes will be carried out, in this case, AppSorteos. The video of the sweepstakes will be published in stories.
Entries that do not meet the mandatory data requested or whose data are incorrect will not be accepted. If the personal data are uncertain or incomplete or not updated, CURIARA may not award the prize to the winner if applicable.

4. PROTECTION OF PERSONAL DATA
In compliance with the LOPD 3/2018 and the General Data Protection Regulation of the European Union, CURIARA informs users that the personal data they voluntarily provide will be incorporated into an automated file owned by and under the responsibility of CURIARA.
By participating in the Promotion, the participant expressly authorizes CURIARA to use his/her personal data stored on Instagram to manage this Promotion.
CURIARA will only use the personal data requested to verify that participants and winners comply with the requirements set forth in these Terms and Conditions. Once this purpose has been fulfilled, the personal data appearing in the public Instagram profile will not be incorporated into any CURIARA file.
Instagram does not sponsor, endorse, or administer, in any way, the Promotion, nor is it associated with it.
5. GENERAL CONDITIONS AND EXCLUSION OF LIABILITY
Participants, by the mere fact of participating in this Promotion, accept its Legal Bases, as well as the criterion of CURIARA for the resolution of any issue arising from the interpretation and execution of these Legal Bases.
CURIARA is not responsible for incidents and events of any kind that are caused by a breakdown in the computer system due to a case of force majeure, nor for incidents that have their origin in cases arising from causes such as a breakdown in the telephone network, computer, electricity or caused by natural external agents (atmospheric, climatological) or by a malfunction of the companies supplying such services.
CURIARA is not responsible for any errors, incidents or damages that may occur in the development of the Promotion and that are attributable to third party entities that manage it.
CURIARA is not responsible for the use of the prize by the winner.
CURIARA will not be responsible for any incident that occurs after delivery and during the enjoyment of the prize.
CURIARA is not responsible for possible losses, delays or any other circumstance attributable to third parties or the Internet that may affect the participation and development of the Promotion.
Likewise, CURIARA is not responsible for any errors that participants may make when providing their personal data.
CURIARA reserves the right to modify at any time the conditions of the Promotion, provided that there is a justified cause or force majeure, undertaking to communicate the new legal bases, conditions of the Promotion or the definitive cancellation.
CURIARA reserves the right to suspend, cancel or postpone its Promotion, in which case it undertakes to make this circumstance known. In the event that the Promotion is temporarily suspended during its operation or postponed on its start date, the participation systems initially established will be blocked, maintaining, in any case, the participations already obtained by users up to that date at the time of its reactivation.
CURIARA reserves the right, if deemed necessary, to leave the prize vacant.
CURIARA intends that the Promotion be done on an equal opportunity basis among the different participants. Therefore, any abusive or fraudulent use of these Legal Bases will result in the consequent disqualification of the participant in the Promotion, denying him/her entry and not allowing access to the participant in question.
In the event that CURIARA or any entity that is professionally linked to the Promotion detects any anomaly or suspects that a participant is impeding the normal development of their participation in the Promotion, illegally altering their registration or their participation through any procedure, technical or computerized in order to falsify their participation, it may unilaterally delete the registration of that participant. In this regard it is important to add that CURIARA and the companies involved in the management and production of this Promotion have enabled the necessary technological supports to detect any possible fraudulent, anomalous or fraudulent action that seeks to alter the participation in the Promotion with the aim of achieving a prize or refund illegally. Therefore, CURIARA reserves the right to remove from the registry any participant who evidences or is suspected of irregular behavior in the sense described above, without any notification to the participant.
Entries that do not meet the mandatory data requested or whose data are incorrect will not be accepted. If the personal data are uncertain or incomplete or not updated, CURIARA may not award the prizes to the winners if applicable.
The participant expressly consents, and by the mere fact of participating in this Promotion, that CURIARA may use his/her name for the purpose of announcing the winner of the Promotion to the rest of the users and without generating any remuneration in favor of the participant.
The prize cannot be exchanged for cash or any other prize. The prize is non-transferable. The commercialization and/or sale of the prize is prohibited. In case of detection of actions aimed at the resale of the prize (either directly or indirectly under the guise of sale or donation of another product), CURIARA will immediately demand the return of the prize, reserving the exercise of the appropriate extrajudicial and judicial measures, including those aimed at protecting its corporate image. It may also bring such actions to the attention of the appropriate authorities.
When the prize is subject to manufacturer’s or supplier’s warranty, in case of failure or malfunction of the item, the winners must contact the technical service of the supplier or manufacturer of the same, being CURIARA exonerated from any liability arising from the failure or malfunction of the item.
When the prize consists of a trip, it is understood that excluded from the prize, unless expressly stated otherwise, are the travel expenses of the winners and, if applicable, their companions to the place of departure, airport taxes or any other type of station, extra expenses in hotels, possible supplements due to fuel surcharges, expenses derived from visas and any other expenses derived from goods or services that exceed the definition of the prize detailed in these Legal Bases.
6. INTELLECTUAL PROPERTY RIGHTS
The content, branding and materials that are part of this Promotion are protected by copyrights, trademarks, patents, trade secrets and/or other proprietary rights and applicable laws. No material from these pages may be copied, reproduced, modified, published, transmitted or distributed in any form or by any means, without the prior written permission of CURIARA and in accordance with the provisions of these Terms and Conditions.
7. TAXATION
The prizes of this Promotion shall be subject to the tax laws in force.
8. DISPUTE RESOLUTION
In all matters not provided for in these Legal Bases, this Promotion shall be subject to the provisions of the Spanish regulations applicable at the time it is carried out.
For any dispute that may arise in the interpretation and application of these Terms and Conditions, both CURIARA and the participants in this Promotion expressly submit to the jurisdiction of the Courts and Tribunals of the city of Madrid.
CURIARA reserves the right to take legal action against those persons who carry out any type of act that could be considered manipulation or falsification of the Promotion.
